Law Student Moves Bombay High Court Over Professor Tearing Up Answer Sheet

A law student from DY Patil Law College in Pune has filed a petition with the Bombay High Court after a professor allegedly tore up his answer sheet during an examination. The incident has raised significant concerns about academic fairness and the treatment of students within educational institutions.

Incident Details

The student, Gaurav Dnyandeo Kakade, reported that during an examination, he requested additional supplementary sheets as the provided 36-page booklet was insufficient for his needs. This request allegedly provoked a hostile reaction from the supervising professor. According to Kakade, the professor, who was claimed to be in an inebriated state, taunted him for sending an email request for additional sheets to the college principal and subsequently tore up his answer sheet.

Legal Proceedings

The student initially approached the college principal to report the incident. Although he was assured of appropriate action, he later faced pressure from the Chief Examination Officer to sign an undertaking admitting to “unfair means” during the exam. Kakade refused to sign this undertaking, leading to further complications.

High Court Intervention

Frustrated with the college’s response, Kakade filed a petition in the Bombay High Court. A division bench comprising Justices Atul Chandurkar and Rajesh Patil has taken up the case. The court issued a notice to DY Patil Law College and ordered the preservation of CCTV footage from the examination hall and the principal’s office to ensure that all evidence is available for review.

Student’s Demands

Kakade’s petition seeks several remedies:

  • Quashing of the biased report by the Student Grievance Redressal Committee, which he claims was unjust and inappropriate.
  • A directive to the college to allow him to rewrite his exam under fair conditions.
  • Ensuring that no further unfair actions are taken against him.

Court’s Observations

The court emphasized the importance of maintaining academic integrity and fairness. The decision to preserve CCTV footage indicates the court’s intent to scrutinize the evidence closely to ensure a just resolution.
